Introduction

These Terms of Use (the “Terms”) govern your access to and use of the UniMarkets website, applications, and related features (collectively, the “Interfaces” or “Site”) provided by UniMarkets (“UniMarkets,” “we,” “us,” or “our”). These Terms, together with any documents expressly incorporated by reference (including our Privacy Policy), form a binding agreement between you and us. By accessing or using the Interfaces, you agree to be bound by these Terms. If you do not agree, do not access or use the Interfaces.

Important: UniMarkets is a fictional, points-based prediction market simulation. It does not involve real money or real-world financial instruments. Coins/points have no monetary value and cannot be redeemed for cash or any other form of compensation.

The Site and Features

Description

The Site provides:

  • Content Features: Prediction market listings, simulated outcomes, leaderboards, user profiles, and other informational/game elements.
  • Technology Features: Account management, points balances, simulated “trades” in YES/NO markets, market creation tools, and other in-app interactions using virtual points (“Coins”).

No real money is involved. All trading and outcomes are simulated for entertainment and educational purposes only.

No Financial Advice

Information on the Site is provided for informational, educational and entertainment purposes only and does not constitute professional, legal, tax, investment or any other advice. Do not rely on any content for real-world financial decisions.

Availability

The Site or Features may be unavailable, inaccurate, or modified at any time due to maintenance, outages, third-party issues, or other causes. We are not liable for unavailability or data loss.


Modifications

To the Terms

We may modify these Terms at any time. The updated Terms will indicate the “Last updated” date and are effective upon posting. Your continued use of the Site after changes become effective constitutes acceptance.

To the Site or Features

We may add, change, suspend, restrict, or discontinue any Feature or the entire Site at any time, with or without notice, including limiting access to certain users or geographies.


Eligibility & Accounts

Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Interfaces. If you are accepting these Terms on behalf of an entity, you represent you have authority to bind that entity.

Accounts & Security

You are responsible for your account, including safeguarding credentials and restricting access to your device. You must use appropriate handles/avatars and must not impersonate others or engage in misleading behavior.

Coins & Trades

Coins are virtual points for use solely within UniMarkets. They are not currency, not a security, and not redeemable for any monetary value. “Trades” are simulated interactions with prediction markets and have no real-world financial effect.

Prohibited Conduct

You agree not to, and not to help or enable others to:

  1. Violate any applicable law or regulation.
  2. Upload content that is illegal, abusive, harassing, defamatory, hateful, threatening, bullying, pornographic, non-consensual, or otherwise objectionable.
  3. Post doxxing, private contact details, private academic records, private health or sexuality information, non-consensual intimate content, or other private information about another person.
  4. Create markets about an identifiable person where the market is intended to harass, shame, expose private facts, pressure the person to disclose private information, or speculate about sensitive personal data.
  5. Create markets that require non-public personal information for resolution unless you have the affected person's permission or another lawful and verifiable basis.
  6. Cheating/manipulation: e.g., creating multiple accounts to game leaderboards, fabricating interactions, or exploiting bugs.
  7. Attempt to circumvent access controls, rate limits or security; probe/scan systems; introduce malware.
  8. Scrape, harvest or bulk-collect data without written permission.
  9. Reverse engineer or decompile the Interfaces, except where such restriction is prohibited by law.
  10. Use the Site for any commercial purpose without our prior written consent.
  11. Impersonate other users or create misleading markets.

We may investigate violations and suspend or terminate access at our discretion.


Market Resolution

Markets should be resolvable from publicly available, consented, or otherwise lawful and verifiable evidence. We reserve the right to void markets, correct errors, reject evidence, or adjust resolutions at our discretion to maintain platform integrity.

If a market cannot be resolved without exposing another person's private information, or if the creator cannot provide adequate evidence, consent, or another lawful basis for the required information, we may resolve the market as invalid. Creating markets that predictably cannot be resolved may reduce creator standing, visibility, or other platform privileges.

User-Created Markets & Personal Information

Users may suggest and create prediction markets on the Site. Some markets may reference people directly or indirectly. If you create, suggest, post, or submit evidence for a market that references personal information—whether about yourself or others—you are responsible for that content and for having the rights, permissions, and evidence needed to use it.

  1. Your Responsibility. You represent and warrant that you have the right to use any personal information included in markets, posts, comments, reports, or resolution evidence you submit and that such use complies with applicable privacy, data-protection, personality-rights, copyright, and other laws.
  2. Identifiable People. A person may be identifiable even without a full legal name, including through a first name plus initial, handle, image, course, workplace, university, location, or surrounding context. If a reasonable audience could identify the person, treat the content as personal information.
  3. Consent and Evidence. We generally do not verify consent before every market appears. However, if a market concerns an identifiable person and that person objects, or if resolution requires private information, you may be asked to provide public evidence, consent, or another lawful basis. If you cannot do so, the market may be edited, removed, restricted, or resolved as invalid.
  4. Sensitive Categories. Do not create markets or submit evidence about another person's health, pregnancy, sex life, sexual orientation, political opinions, religion, racial or ethnic origin, biometric or genetic data, trade union membership, criminal allegations, non-consensual nudity, or comparable sensitive private matters unless you have a clear legal basis and UniMarkets has expressly allowed the content.
  5. Review Is Not Endorsement. UniMarkets may review, approve, reject, edit, remove, restrict, or resolve markets and suggestions. Approval or continued availability does not mean UniMarkets verifies truth, consent, legality, or endorsement of the content.
  6. Reports and Objections. If someone reports that content identifies them, violates their rights, or exposes private information, we may act on the report without prior notice to preserve safety, privacy, or legal compliance.
  7. Indemnification. You agree to indemnify and hold UniMarkets harmless from any third-party claims resulting from personal information you include in markets you create.
  8. Removal. We reserve the right to remove or modify any market that we believe violates these Terms, applicable law, or the rights of others, without prior notice.

Third-Party Services

The Interfaces may link to or integrate third-party services (hosting, analytics, authentication, etc.). Your use of such services is governed by those third parties' terms and policies. We are not responsible for third-party content, availability, or practices.


Intellectual Property

Ownership

The Site, its content, logos, designs, code, and related intellectual property are owned by UniMarkets or its licensors and are protected by law.

License to You

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Interfaces for their intended, non-commercial purpose.

Your Content & Feedback

If you submit content or feedback, you grant UniMarkets a worldwide, royalty-free, transferable, sublicensable license to use, host, reproduce, modify, adapt, publish, translate, display and distribute such content for operating and improving the Interfaces. You represent you have the rights to grant this license.

Privacy

Please see our Privacy Policy for how we collect and process information. By using the Site, you consent to those practices.

Disclaimers

  1. “As Is.” The Interfaces are provided as is and as available without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and availability.
  2. No Monetary Value. Coins have no monetary value; simulated trades have no financial consequences.
  3. No Professional Advice. Nothing on the Site constitutes professional, financial, or legal advice.

Limitation of Liability

To the maximum extent permitted by law, UniMarkets and its officers, directors, employees, partners, and suppliers will not be liable for indirect, incidental, special, consequential, or exemplary damages (including lost profits, data, goodwill, or use), even if advised of the possibility. Our aggregate liability arising out of or relating to the Interfaces shall not exceed €100 (or the minimum amount permitted by law if higher).

Some jurisdictions do not allow certain disclaimers or limitations; in such cases, they apply to the fullest extent permitted.

Indemnification

You agree to defend, indemnify, and hold harmless UniMarkets and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Interfaces; (b) your content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.


Governing Law & Dispute Resolution

Governing Law & Venue

These Terms are governed by the laws of Germany, without regard to conflict-of-laws rules. Courts in Germany shall have exclusive jurisdiction for any dispute.

Informal Resolution

Before filing a claim, the parties will first attempt to resolve the dispute informally by written notice and a 30-day discussion period.

Suspension & Termination

We may suspend or terminate your access at any time, with or without notice, including where we believe you violated these Terms. Upon termination, your license ends and you must stop using the Interfaces.

Changes to Services

We may change or discontinue the Interfaces at any time. Sections intended to survive termination (including IP, disclaimers, limitations of liability, indemnification, and governing law) will survive.

Miscellaneous

  • Entire Agreement. These Terms and documents incorporated by reference constitute the entire agreement between you and us.
  • Severability. If any provision is invalid, the remainder remains in effect.
  • No Waiver. A failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms without our consent. We may assign them without restriction.
